Executive VA Academy Inc. Terms of Use Agreement and Liability Disclaimer

All Executive VA Academy courses, exercises, assignments, videos, documents and other associated content (hereinafter collectively referred to as “EVAA”) have been produced and are administered by Executive VA Academy Inc. When you purchase a membership with the Executive VA Academy Inc., you agree to this Terms of Use Agreement and Liability Waiver.

All sales for the EVAA are final. No refunds are issued once a sale is completed. Memberships purchased on the monthly plan may terminate their membership plan with 30 days' notice. Memberships purchased on the annual plan cannot terminate their plan until their renewal period comes due. It is the responsibility of the member to terminate their own plan or reach out to hello@executivevaacademy.com to request their membership be canceled before the next payment period. Access to course materials are available for at least two years after the purchase date. 

The computer, supplies, or other equipment for any instructional assignments are not included in the purchasing price of the EVAA course.

The information in our EVAA course is for educational purposes only. Executive VA Academy Inc, its directors, officers, employees, and agents make no representations, guarantees, or warranties that the information provided by EVAA is appropriate for you or will result in you obtaining employment in any type of employment or business success. The information provided by EVAA is by no means complete or exhaustive and therefore does not apply to every person or business.

By purchasing a membership with EVAA, you are assuming the risk that the materials, exercises, and assignments provided by EVAA may not be appropriate for the type of work that you wish or intend to pursue. 

By purchasing a membership with EVAA, Executive VA Academy Inc grants you a nonexclusive, non-transferable, revocable license to access and use our copyrighted EVAA materials and any associated materials solely for your own personal and non-commercial use. Our EVAA membership and materials are protected under Canadian and foreign copyright laws. The copying, redistribution, use, or publication by you of any of the content provided by EVAA is strictly prohibited. Your purchase of our EVAA membership does not grant you any ownership rights to our EVAA course. Any breach in the terms of this agreement may result in termination of your access to the EVAA course materials without a refund.

EVAA materials may contain references or links to materials from third parties. Reference to any third-party products, services, processes, or other information, by trade name, trademark, manufacturer, supplier, or otherwise does not constitute or imply endorsement, sponsorship, or recommendation thereof, or any affiliation with Executive VA Academy Inc. As a result, Executive VA Academy Inc, its directors, officers, employees, and agents are not responsible for examining or evaluating the content or accuracy, and therefore Executive VA Academy Inc, its directors, officers, employees, and agents do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. Executive VA Academy Inc, its directors, officers, employees, and agents are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third party.

Our EVAA membership and materials are intended solely for Users who are at least age 18 years of age or older. Any use of or access to EVAA by anyone under such age is unauthorized, unlicensed, and in violation of these Terms of Use. By purchasing a membership with EVAA, you represent and warrant that you are 18 years or older and that you agree to and abide by all of the terms and conditions of this Agreement. Executive VA Academy Inc, its directors, officers, employees, and agents have the sole right and discretion to determine whether to allow membership with EVAA to any individual and they may reject a purchase by any individual with or without explanation.

When you complete the purchase process with EVAA, you will receive a password that will allow you to access the EVAA platform. You agree to maintain the confidentiality of your password and are fully responsible for all liability and damages resulting from your failure to maintain that confidentiality and all activities that occur through the use of your password. You agree to immediately notify Executive VA Academy Inc. at hello@executivevaacademy.com of any authorized use of your password or any other breach of security.

The content provided by EVAA is provided “as is,” “as available,” with “all faults”, and all warranties, express or implied, are disclaimed (including but not limited to the disclaimer of any implied warranties of merchantability and fitness for a particular purpose). The website of the Executive VA Academy Inc., (hereafter “executive website”) and every EVAA materials and or coaching may contain bugs, errors, problems, or other limitations. Executive VA Academy Inc., including its directors, officers, employees, and agents, have no liability whatsoever for your use of the materials and or coaching provided by EVAA. 

Executive VA Academy Inc. cannot guarantee and does not promise any specific results from their membership program, materials, videos, training, and coaching. Executive VA Academy Inc, including its directors, officers, employees, and agents, does not represent or warrant that the said EVAA membership or any services found within are accurate, complete, reliable, current, or error-free, or that any such items are free of viruses or other harmful components. Therefore, you should exercise caution in the use and downloading of any such EVAA courses, and use industry-recognized software to detect and remove viruses. All responsibility or liability for any damages caused by viruses somehow attributed to EVAA services and membership program is disclaimed. Without limiting the foregoing, you understand and agree that you download or otherwise obtain content through the EVAA website, courses, and membership program at your own risk and that you will be solely responsible for your use thereof and any damages to your mobile device or computer system, loss of data or other harm of any kind that may result.

In no event will Executive VA Academy Inc, including its directors, officers, employees, and agents, be liable to you or any third person for any indirect, consequential, exemplary, incidental, special, or punitive damages arising from your use or misuse of the EVAA materials, whether such damages arise in contract, tort, negligence, equity, statute or by way of any other legal theory regardless of whether such damages could have been foreseen. Notwithstanding anything to the contrary contained herein, the liability of Executive VA Academy Inc, its directors, officers, employees, and agents to you for any cause whatsoever, and regardless of the form of the action, will at all times be limited to the amount paid, if any, by you to Executive VA Academy Inc. for the access and services provided prior to the event giving rise to liability.

This Terms of Service Agreement shall be governed and construed in accordance with applicable federal laws and the substantive laws of Province of Alberta, Canada, without giving effect to the principles of conflict of laws. Should any part of this Agreement be held invalid or unenforceable, that portion shall be construed consistent with applicable law and the remaining portions shall remain in full force and effect.

To the extent that any EVAA materials, coaching, videos, and training are in conflict or inconsistent with this Agreement, this Agreement shall take precedence. The failure of Executive VA Academy Inc. to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision. The rights of Executive VA Academy Inc. under this Agreement shall survive any termination of this Agreement.

Executive VA Academy Inc. can not guarantee and does not promise any specific results from the use of the website of Executive VA Academy Inc. or from the use of courses and/or coaching prepared, administered, and sold by Executive VA Academy Inc. no matter how the material is delivered.
